Terms of Service

1. Who we are & acceptance

CueJam ("CueJam", "we", "us") operates a web platform that lets artists run live shows and lets audiences request, upvote, react to, review, boost on, and tip songs. By using CueJam you agree to these Terms.

2. Eligibility

• You must be 18 or older to boost, tip, or transact. Those aged 13–17 may use free engagement features only with a parent or guardian's consent and may not transact.
• The service is not directed to children under 13 (COPPA); we do not knowingly collect their data.

3. Accounts & acceptable use

• Transactions require a verified email or phone (one-time code). Keep your credentials secure.
• Don't defraud, spam, manipulate votes or boosts, harass others, or post unlawful or infringing content. We may suspend or remove accounts and content that violate these Terms.

4. Boosts, tips & fees

• A boost places a card authorization (hold). We capture it only if the artist plays your song; if the song is declined, skipped, or not played, the hold is released automatically.
• Tips are charged immediately and are non-refundable once captured, except as required by law.
• CueJam retains a 15% platform share of captured tips and boosts; engagement-only shows carry a flat $10 artist fee. Payments and payouts are handled by Stripe; artists are the payees.

5. Performance rights

Artists are solely responsible for obtaining all performance, mechanical, and public-performance licenses (e.g., ASCAP/BMI/SESAC) and venue clearances. CueJam grants no music rights and disclaims liability for performed content.

6. Disclaimers & limitation of liability

• The service is provided "as is" and "as available"; we don't warrant that a requested song will be played or that the service is uninterrupted.
• To the maximum extent permitted by law, CueJam is not liable for indirect or consequential damages, and our total liability is capped at the greater of the fees you paid us in the prior 12 months or US$100.

7. Binding arbitration & class waiver

Disputes are resolved by individual binding arbitration under the Federal Arbitration Act, and class actions are waived. You may opt out of arbitration by emailing us within 30 days of first accepting these Terms.

8. Copyright (DMCA)

We respond to DMCA notices and remove infringing content. Send notices to our designated agent at reach@cuejam.live; repeat infringers are terminated.

9. Governing law & termination

These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-laws rules. We may suspend or terminate access at any time; payment, arbitration, and liability terms survive.
